The project Carrying out the Government of Viet Nam's policy on the national industrialization and modernization program, the state Electricity of Vietnam (EVN) has decided to use World Bank financial resources in the fiscal year 2002-2003 for the project investment of "System Efficiency Improvement, Equitization and Renewable Project (SEIER)". To meet the target, EVN has authorized the project implementation with its letter No 1905/EVN/KH - HDQT for feasibility study report and establishment of the expected projects which will use WB financial resources in the fiscal year 2002-2003. Power Company No.2, on behalf of EVN, will develop the 15 sub-projects in I I provinces. This Resettlement Action Plan (RRAP) is prepared for 15 sub-projects which is managed by Power Company No.2 (PC2). 2. Legal framework and waiver provisions The RAP for these sub-projects under PC2 is based on the Policy Framework for Compensation, Resettlement and Rehabilitation prepared for the SELER Project ( see annex 1). According to the policy framework, eligibility for compensation and rehabilitation entitlement includes all affected persons, households and institutions with or without legal title on their assets included in the RAP inventory prior to the RAP cut-off date. The amount of compensation will be noted in the Resettlement Information Booklet (RIB). If there is a delay of more than six months in the time of cost estimation and the payment of compensation, the amount in the RIB will be adjusted accordingly. 3. Impacts of the project The impacts consists of: + Temporary impacts during construction stage including the damage of trees, crops and assets around area which used for constructing pole foundations/ substations or on the temporary road served for construction activities; + Permanent impacts on trees, crops, houses, assets due to acquisition of land for erecting poles, constructing substation and access road; permanent impacts on assets in ROW due to the regulation of Decree No. 54/1 999/ND-CP. Total demolished area is 4,777.9m . All of PAP impacted on houses still have sufficient remaininjg residential land (adjacent un-impacted areas) for reorganizing their houses, therefore, no requirement of displacement of PAPs to new sites. Land which would be acquired permanently for the project is 96,269.71m2, most of it is agricultural land. Land which would be affected temporarily during construction stage is 301,803 m2 Some trees have to be cut, most of them is fruit trees and the remaining are industrial trees such as rubber, cashew, pepper. The affect of project is classified into 7 categories as presented in details in Chapter III, the number of PAPs and impacted assets are broken down by categories and shown in Chapter IV. 7'he substations and connectin.g tap/transmission lines do not locate or go through ethnic minori/t communities, and therefore, there are no impacts ethnic minorities. For the socio-economic survey, 136 PAP households were interviewed, Of which, the biggest family has 11 members, the smallest one has 2 members. The average family size is 5.8 member/household. The average income is 1,200,000 VND/monthlhh, PAPs earning income mainly from agricultural activities. Iv For the family amenities, more than 70% of PAPs are supplied with electricity, well and TV; 60% of PAPs have bicycle, 50% of PAPs have radio, 40% have motorbike; 10% of them have telephones. Most of houses are classified at type 4 according to the Vietnamese standards. 4. Entitlement policy The cut-off date (the date of completion census and inventory) is June 30, 2001. Compensation costs will be based on replacement/market costs. Compensation at replacement cost for land, houses and perennial trees; compensation at market price for annual crops. All PAPs are entitled to (i) transport allowance; (ii) relocating subsidy; and (iii) trainings or other restoration measures for PAPs permanently losing more than 25 % of their agricultural land or who will be resettled. However, in this sub-project, there are no PAPs losing more than 25% of land or who will require relocation. All PAPs affected on houses still have sufficient remaining land for reorganizing houses. 5. Public participation and consultation This RAP is prepared in a close consultation with local authorities of II project provinces and PAPs in order to minimize impacts on people and maximize their participation in resettlement planning and implementing and the socio-economic benefits of PAPs to the project. Eleven PPCs and their affected administrative units and PAPs were consulted about lines alignments, draft resettlement policy, RAP implementation, grievance mechanism and monitoring and evaluation the restoration of PAPs' livelihoods after the project implementation. 6. Complaint and grievances During the project implementation, PAP's complaints and grievances will be dealt with according to the regulations of Vietnamese laws. PAPs raising complaints will be treated fairly and guided by related agencies on the order, procedures and complaints of RAP, in addition no fee will be paid for their complaints. 7. Institutional arrangement PC2 and its PMB are responsible for all of operations on investment guidelines, investigation and design, project construction as well as supervision of compensation and resettlement of the project, operating establishment - implementation of the project through particular foundations in order to approve decisions relative to resettlement. RAP implementation will also need well coordinated by local authorities all relevant institutions. 8. Monitoring and evaluation The implementation of RAP shall be constantly supervised and monitored by PC2's Project Management Board (PMB). Moreover, an independent consulting agency or individual consultants will be entrusted with independent monitoring task. The independent consulting agency selected by PC2 will make a contract just after RAP approval and will begin supervision and monitoring activities from the beginning of the implementation phase. 9. Schedule Just after the investment for the project is approved, PAPs again will be fully informed of their rights and the policies of this RAP including legal framework, eligibility provision; entitlement policy; mode and rates of compensation, implementation schedules and complaint and grievance rights, mechanism. Such information will be delivered to the PAPs by PMB of PC2 via meetings and documentation such as pamphlet to be distributed to each PAPs. Compensation for impacted houses shall be provided at least 3 months before the be-inning construction work. PAPs affected on houses prefer to receive compensation in cash and organize construction of new houses themselves on their unaffected residential land. Allowances and subsidies and other affects assets will be paid at least one month prior to land clearance. All RAP activities must be satisfactorily completed before the World Bank will give a no objection for award of contract for the sub-projects. Any changes to the RAP after WB clearance will require review by the WB Office in Hanoi before commencement of construction. Cost for RAP Total cost of RAP program is estimated 11,854,767,000 VND (US $790,318), of which cost for compensation and subsidy for PAPs is 8,111,316,124 VND (US$540,754). 11. Disclosure The draft RAP has been disclosed at the office of Provincial People's Committees of 11 project provinces (Binh Thuan, Ninh Thuan, Binh Phuoc, Binh Duong, Ba Ria-Vung Tau, Kien Giang, Ca Mau, Bac Lieu, Dong Thap, Soc Trang, Vinh Long) and at Vietnam Development and Information Center (VDIC) of the World Bank office in Hanoi. VI CHAPTER I INTRODUCTION OF THE PROJECT 1. OBJECTIVE OF THE PROJECT The objectives of project are to: + Increase the service ability in rural power grid, to create technical condition for widening the distribution system to serve for poor households which are far away from the existing power grid. + Reduce power losses -+- Improve voltage quality. 2. SCOPE OF THE PROJECT The project includes 15 sub-projects located in 11 provinces, South Vietnam. The scope of the project consists of + Fifteen I I OkV substations with total installed capacity of 405 MVA, all of them are the new one; + 1 5.771 km of double-circuit 1 IOkV TL (these are the connecting tap from the national grid to substation) + 8 1.797 km of single-circuit I IOkV TL (these are the long lines, connecting tap from the national grid from one place to substation located at another place. There are 4 TL like that). SUBSTATION DESCRIPTION All substations are built following semi outdoor type: the transformer, busbar, and some of equipment used for switching and measuring are arranged outdoor, protecting equipment and distribution switchgear are arranged indoor, in control room. The substation is separated with outside by fences. The dimension of substation is around 50mx7Om. All substations are located near transportation road, easy for transporting the equipment and materials in the construction phase and comfort for connecting to local distribution network in the operation phase. The access road is also built at the same time and staff house may be included in the case the substation stay far from the town. For this project, all substations are the new one and the proposed locations are agricultural land or residential land. 4. TRANSMISSION LINE DESCRIPTION The TL transmits the power from national grid to the substation, at this the power will be transformed from high voltage level to lower voltage level. The TLs are supported by 20m centrifugal concrete pole or steel tower and isolated by strings of insulators and steel cross-arms. The foundation are made of reinforce concrete for steel tower or blocking foundation for 20m centrifugal concrete pole. The average span (the distance between two pole) is around 200m. The ROW, following the typical design of the pole, will be 13m in width (in the case of single-circuit) or 15m in width (in the case of double-circuit). The TLs are overhead line type, with the safety distance from conductor to the ground, obeyed The Norm of electrical equipment I ITCN-19-84, Clause 11.5.93 and 11.5.107, are: • 7m for high density area; 2 6m for low density area. The TL I OKV is stretched through paddy field, hill, rough land on the territory of Ba Ria town and Chau Duc district, Ba Ria Vung Tau province. Thoi Binh Sub. is located next to Tac Thu road - Thoi Binh 8 Thoi Binh Sub. & Ca Mau - Thoi Binh town, on the plain of Thoi Binh commune, Thoi Binh district, TL Ca Mau province. The TL 1 OKV is located on the plain of Ca Mau city and Thoi Binh district, Ca Mau province. Hong Ngu Sub. is located on the paddy field of An Thanh B Hong Ngu Sub. & An Long - Hong Ngu hamlet, An Binh A commune, Hong Ngu district, Dong Thap 9 TLprovince. The TL I OKV is located next to Highway No.30 on the area of Tam Nong district, Hong Ngu district, Dong Thap province. Tani Uyen Sub. is located on the lelf of No.747 road, 2km far 15 Tan Uyen Sub. & Binh Chuan - Tan from Tan Uyen town, on the territory of Tan Uyen district. Uyen TL Binh Duong province. The TL I IOKV is paralled with No. 747b interprovincial highway, on the Thuan An and Tan Uyen district, Binh Duong province. RAP OF SUB-PROJECTS MANAGED BY PC 2 4 5. GOV DECREE NO. 54/1999/ND-CP ON SAFETY PROTECTION FOR HIGH VOLTAGE POWER GRID The Decree No.54/1999/ND-CP of July 8th, 1999 on safety protection for high voltage power grid has stipulated as follows: For 11 Ok V TLs, following Article No. 6, the RO W is defined as: Length: from conductor suspending point on feeder pole of one substation to conductor suspending point on dead-end pole next to succeeded substation; Width: limited by 2 vertical planes located 2 others sides of the TL, paralleled with the TL and has the distance of 4m from same side outer conductor; Height: account from foundation to top of pole plus 3m of safety distance. Following Article No. 7, for trees lay in bound of ROW: Crops should be grown at least 0.5m far from pole/ anchor foundation . Trees should ensure the vertical distance from conductors at stable status to the highest point on tree not less than 3m. For trees, which grow rapidly in short time, can be able to violate the TL's safety (such as eucalyptus, bamboo, ...), they should be cut and banned for growing new. Following Article No. 8, for houses and structures lay in bound of RO W: Houses and structures exist before project could be able to keep back and no need to move out of ROW if satisfying following conditions: + Made of hard-firing materials. + Metal structures must be grounded. + Distance from conductors at stable status to any point of houses or structures not less than 4m. + Conductors across houses or structures must be applied reinforce methods on electric and civil. For houses and structures exist before project, if they do not satisfy one of these above conditions, then the investor has to pay for upgrading for getting satisfying all. If houses and structures lay in bound of ROW have to move out of ROW then the project's investor has to compensate to the owners/ users following stipulation of law. For I OAkV substations, following Article No.14, the ROW is accounted from the fences of substation to outside 0.5m. The height of ROW is accounted form deepest point of foundation of substation items to highest point in substation plus the safety vertical clearance 3m. 6. AFFECTED LAND The impacts on land is classified in two cases: + Permanent impacts : including the area required for building substations, the area of ROW (in that area, forbid to built new house, forbid to grow any trees which have ability to RAP OF SUB-PROJECTS MANAGED BY PC 2 5 reach the TL at the distance less than 3m); + Temporary impacts: some affect in short-term (in construction phase) such as affect due to building temporary roads served for construction job, damage trees, crops by conductor stringing. RAP OF SUB-PROJECTS MANAGED BY PC 2 6 CHAPTER II MEASURES TO MINIMIZE LAND ACQUISITION AND LOSSES 1. MEASURES DURING DESIGN STAGE 1.1. Substation's location In that stage, choosing the substation's location is very important. The choosing criteria below have been followed to ensure that the project's affect is minimized + Locations of the subprojects are as near as possible to the existing national grid, that criteria aim to minimize length of connecting tap in order to minimize land acquisition and losses; + Location of project near by transportation road; + Go through less valuable land (empty land, agricultural land, ..); + Selection based on consultation with, agreement of local authorities, local people. There are at least 2 alternatives that are considered for 1 sub-project. The alternative with less impacts on social and natural environments is selected. 1.2. Route selection: During investigating and route study, completely avoid passing through densely populated areas, religious areas, natural forests, natural and historical preserved areas, etc.... The TLs are not run near or parallel with communication system and weapon regions. Changing the direction of TLs when necessary aim to minimize the amount of houses and structures to be affected. The selected TL is about 1km far from the axis of existing national roads. Therefore, the impacts by access roads are minimized. 1.3. .The technical solutions The reasonable distance between 2 poles is studied, using technical applications for: pole, beam, anchor wire, foundation in positions that can have minimum effect on houses and constructions. 2. MEASURES DURING CONSTRUCTION STAGE Optimum construction schedule for minimizing temporary impacts. Temporary roads serving for construction are considered carefully (go through vacant areas) in order to minimize the amount needed. RAP OF SUB-PROJECTS MANAGED BY PC 2 7 The camps for workers in the construction period will be located on the bare public land near by headquarters of comnmunes. The construction work (conductor stringing), pole erection etc. will be done after crops harvested. 3. RESULT OF THE EFFORTS The project consists of 15 sub-projects. The sub-projects' optimum alternatives have been chosen from 02 to 03 alternatives of route and substation location. The project investment is large, in which there are 15 substations and connecting tap with length of 97,568km. However, its land acquisition is only 96,270m2, of which residential land takes into account of 6.4%. There are 100 PAP households who will have houses affected; this makes 18% of total affected PAP households. 7'here are no PAPs who have more than 25% of their total land holdings affected No impayrcis on natural preservin7g zones, vestiges, and pagodas. Almost all of PAPs opted for cash compensation measure for their impacted land at replacement costs. RAP OF SUB-PROJECTS MANAGED BY PC 2 8 CHAPTER III LEGAL FRAMEWORK ANI) ENTITLEMENT POLICY I LEGAL FRAMEWORK Both OD 4 30 on Involuntary Resettlement of the World Bank and Viet Nam laws on Compensation and resettlement are applied. 1.1. The application of laws, decrees and regulations of the socialist republic of Viet Nam and legal documents, as follow: 1. The 1993 Land Law: of Socialist Republic of Viet Nam published by President of Government dated July 14 1993. 2 Decree No.22/1998/ND-CP issued on 24 April 1998 by GOV regulates compensation for recovered land by the Government for defense, security, national and public interests. - Circular No. 145/1998/TT-BTC issued on 4 November 1999 by the Ministry of Finance. - Decree 54/1999/ND-CP issued on 8 July 1999 by GOV regulate the protection for the safety of HV systems. - Decree No.64/CP dated 27 September 1993: on the distribution of agricultural land to the households in long term for the agricultural purpose. - Decree No.87/CP dated 17 August 1995 on the stipulation of the frame for the price of land types. - Circular No.05-BXD/DT dated 9 February 1993 on the classification of the house types. - Decision of Provincial People's Committee on the land recover for the purposes of public interests 1.2. The guideline OD 4.30 of WB dated June 1990 According to the OD 4.30 on involuntary resettlement, PAPs shall be compensated and assisted in such a way as to warrant the improvement or at least the maintenance of pre-project living standard condition. All PAPs, which are included in the RAP inventory list, are entitled to compensation for their affected properties. The households, which are squarters/encroachers into the proposed affected area after the cut-off day, are illegal and therefore, not entitled to compensation and rehabilitation. Also for compliance with World Bank OD 4.30, compensation rates will be provided at replacement cost for land, houses, buildings, trees and at market rates for crops. RAP OF SUB-PROJECTS MANAGED BY PC 2 9 1.3. Required waivers In order to carry out the RAPs in accordance to World Bank OD.4.30 on Involuntary Resettlement a number of articles in various Vietnamese laws and regulations which do not ensure compensation at replacement cost or set eligibility provisions which do not extend the right to compensation and rehabilitation to households without proper land papers, will be waived The articles of law and regulations that will be waived are discussed below (i) Eligibility to compensation - Decree 22/CP Article 7 of Decree 22/CP (non-eligible persons for compensation of land) stipulates that "The person whose land is recovered and who has not met one of the conditions stipulated in Article 6 of this Decree or who has violated the plan already ratified by the competent level, and such violation has been announced, or who violates the corridor protecting work, or who illegally occupies land shall not receive compensation when the state recovers the land. The People's Committee of province or City directly under the Central Government shall consider and make decision on a case by case basis". Article 16 of Decree 22/CP (Principle for compensation of lost property), Point 3, stipulates that "The owner of affected property on recovered land as mentioned in Article 7 of this Decree, based on each individual case, the People's Committee of the province or City directly under the Central Government shall consider and decide the assistance". To ensure that the objectives of the RAPs are met, a special decision of the Government waiving Article 7 and Article 16 of Decree 22/CP is needed to permit assistance and rehabilitation measures for illegal users of land as proposed in the RAPs. (ii) Price of land for calculation of compensation According to the Vietnamese regulation, calculation the unit price for land compensation will be based on Decrees 87/CP, 22/CP, 17/1998[ND-CP and Circular 145 of Ministry of Finance. Article 4 of Decree 87/CP states that, compensation of land must fall within the Government's range of minimum and maximum prices. *Article 8 of decree 22/CP states that the prices of land for calculation of compensation for recovered land shall be determined on the basis of local prices of land, issued according to the provisions of the Government multiplied by a coefficient 'K' in order to ensure compatibility of the compensation with profitability and the prevailing land prices of the locality. The price of land for calculation of compensation for the project shall be decided by the Chairman of the Provincial People's Committee based on the proposal of the Finance-Pricing Services. Even though the limit of values of the coefficient K has been widened by Decree 17/1998/ND-CP and Decision 302/TTg, to ensure that the compensation of land is at replacement cost, a decision by the Prime Minister regarding a waiver of Decree 17/1998/ND-CP and Decision 302/TTg is required. This is to ensure that the objectives of the RAP are met. Unit prices for land will be established, ensuring compensations at replacement value. RAP OF SUB-PROJECTS MANAGED BY PC 2 10 (iii) Principles for implementation of compensation - Decree 22/CP Article 18 of Decree 22/CP explains the resolution for compensation of affected houses and structures with different legal status of the houses and structures. Article 17 of 22/CP states that houses affected on less than 70% of total ground floor area should be entitled to compensation for the affected area plus rehabilitation cost of the remaining part. Houses affected on more than 70% of the total ground floor are entitled to full compensation cost of the house. To ensure that the objectives of the RAPs are met, a special decision of the Government regarding a waiver of Article 17 and Article 18 of Decree 22/CP is needed to permit assistance and rehabilitation measures for project affected houses and structures as proposed in the RAPs. (iv) Assistance policy for PAPs who rent houses from the government -Decree 22/CP Article 25 of Decree 22/CP states that PAPs (Project Affected Persons) who rent government houses and do not want to continue to do so shall be entitled to compensation at a rate equal to 60% of the cost of the rented house and 60% of the cost the land. To ensure that the objectives of the RAPs are met, a special decision of the Government regarding waiver of Article 25 of Decree 22/CP is needed to permit assistance and rehabilitation measures for Project Affected Families who share rented government housing as proposed in the RAPs. The Prime Minister of Vietnam in approving the policies and objectives set forth in the RAPs will grant the waivers to the above mentioned Articles 7, 8, 16, 18 & 25 of Decree 22/CP; Article 4 of Decree 87/CP. The waivers will he approved by Viet Nam Prime Minister (in the decision of project investment before negotiation. The Project Provincial People Committees will issue the official lelters for their agreement in implementing the policies set forth in RAP by no later than end of Malrch, 2002. 2. DEFINITION OF ELIGIBILITY AND LIMITATION TO ELIGIBILITY Project Affected Persons (PAP) are all individuals, firms or institution (hereafter called the project affected persons-PAPs) with or without land registration papers who owned, rented, or used land, properties and business, which are affected by the project. All PAPs will be entitled to full compensation for their respective losses as long as they are included in the PAPs inventory list or can prove that they used the affected items before the cut-off date. The same applies to PAPs whose incomes are affected by the project. The cut-off date has been fixed as the day of inventory completion, June 30 of 2001. The cut-off date is declared officially by the competent local authorities. Encroachers who settled into the proposed affected area after the cut-off date will have no entitlement to compensation and resettlement. They will be required to demolish their structure and cut the trees or harvest their crops for land clearance to the project. In the case necessary, RAP OF SUB-PROJECTS MANAGED BY PC 2 11 they will be forced to be removed out the proposed project area. Nevertheless, they do not have to pay any fine or sanction. 3. RESETTLEMENT AND COMPENSATION PRINCIPLES: Principles and objectives of this RAP are defined in accordance with Vietnamese laws and operational directive 4.30 of WB. Vietnamese legislation and WB directive have been adapted to fit the specific conditions of the project as defined below 1. Resettlement and compensation programs must be designed so as to follow the improvement or at least the maintenance of the PAP's pre-project living standards. 2 Both Resettlement and land acquisition must be minimized as much as possible 3. Resettlement distant must be minimized if the agricultural replacement land needs to be given, it should be as close as possible to the land that was lost. 4. Cash compensation for land, houses/or structures, trees shall be given at the replacement costs free from depreciation cost of the salvage of the old construction materials, while cash compensation for crops shall be given at market price rates. 5. Resettlement transition period must be minimized and the compensation should be provided to PAPs before beginning the construction activities affecting them. No land clearance if the full compensation have not been done. 6. All PAPs residing/or cultivating land within the project area before the cut-off date are entitled to compensation for their losses and to income rehabilitation. 7. Resettlement and land acquisition plans and all the replacement alternatives should be carried out following consultation with the affected population and it should have popular acceptance of PAPs. The plans are also required to be approved by local Authorities. 8. Resettlement and compensation programs must provide adequate institutional arrangements to warrant effective and timely implementation and proper monitoring. 9. Financial and technical resources for the resettlement, land compensation and subsidies should be available when and where required. 10 The previous level of community services and resource should be maintained or improved in the new sites. 11. Once approved by the Government of Vietnam what stipulated in this RAP will be enforceable as an official legal document. 4. ELIG[BILITY TO COMPENSATION ENTITLEMENT: Legitimate PAPs are all the affected households and institutions included in the inventory with or without legal title included in the RAP inventory or able to demonstrate with other means that prior to RAP cut-off date they owned, rented or used land, and properties associated with land. RAP OF SUB-PROJECTS MANAGED BY PC 2 12 In addition, legitimate PAPs are also all households and institution who prior occupation and/or businesses and related income are affected by the project due to acquisition of land or other assets, temporarily or permanently. 5. COMPENSATION POLICY: Compensation for crops will be provided at market price. Compensation for land, houses, buildings, trees and other assets will be provided at the replacement cost. Compensation for land losses: - Compensation for productive land losses (less than 25% of total land PAPs' holdings) will be provided at the replacement cost for the equivalent area and all other losses will be provided in cash. - Compensation for productive land losses (equal or more than (=/>) 25% of total land PAPs' holdings will be provided in terms of land for land at the equivalent area and quality of land acquired by the project or in cash at replacement cost according to PAPs' options. Compensation prices have been defined in this RAP are tariffs established by the provinces based on the decree 87-CP and the Circular 145 of the Ministry of Finance. Since the time from RAP preparation to time of the project implementation may be long, at the implementation time, such prices may not correspond to market or replacement rates. Therefore, all applied prices will be checked again at the beginning time of RAP implementation and adjusted if necessary. The Detailed Measurement Survey (DMS) will be also carried out by Resettlement Committees at the very beginning of project implementation. The evaluation of unit cost at the implementation time will be done by independent monitoring agency, financial Department of provinces. This activity will be required in ToR for Independent Monitoring later. Compensation for crops will be given in cash at the current market rates calculated on the productive average of the last three years (according to the Circular 145 of MOF) . Compensation for land, houses, buildings and trees will be provided in cash at the replacement costs. 6 IMPACT CATEGORIES AND ENTITLEMENT POLICY By the nature of the project impacts as described above and based on the survey of the PAPs, the impacted categories could be classified as below: 6.1 Temporary Impact within Right of Way (ROW) :AlI the PAP has productive land, crops, trees or structures in ROW of transmission line (T/L), surrounding areas of tower foundations, in the temporary service roads, which are temporarily affected only during the construction period. Category I: PAP has trees, crops, which are damaged by the project during the construction period due to construction of temporary access roads or conductor stringing. Calegorv 2 . PAP has residential, garden, productive lands which are temporarily acquired during the project construction period. RAP OF SUB-PROJECTS MANAGED BY PC 2 13 6.2 Permanent Impact All the PAP owned lands and properties on it, which will be permanently acquired for the tower foundations, the substation areas, the permanent access roads for construction and maintenance of the project. All PAPs have houses, other structures, or high trees in ROW, which need to be removed, demolished or cut. Category 3 . PAP has houses/structures, which are partially damaged or cut, and the damaged portion will not affect to the safety or using purpose of the entire house or structure (the dismantled areas are less then 25% of total areas), and the lost house/structure portion could be rebuilt in adjacent areas already owned by the PAP Impact on cleared residential land in ROW would be temporary as it could be reused for restricted purposes. Category 4 . PAP has house, which are partially or totally damaged, and the damaged portion will affects to the safety or using purpose of the entire house or structure (the dismantled areas are more then 25% of total areas or even less than 25% of total area, but the remaining area can not be used or inconvenient for using), so the house need to be totally removed and rebuild in remaining adjacent areas already owned by the PAPs. Impact on cleared residential areas will be temporary as it can be reused for restricted purposes. Category 5: PAP has houses, which are partially or totally damaged, and the damaged portion will affects to the safety or using purpose of the entire house or structure, so the house/structure need to be totally removed and rebuild. But PAP does not have sufficient spare residential land for the reconstruction of a house of equal dimensions as the house lost. The threshold of sufficient residential land is at least 60 m2 for urban areas and 100 m2 for rural areas. Calegory 6 . Rehabilitation assistance. RAP OF SUB-PROJECTS MANAGED BY PC 2 19 CHAPTER IV CENSUS AND SOCIO-ECONOMIC SURVEYS Census and socio-economic surveys were carried out in May and June, 2001. The socio-economic survey consists of interviewing PAPs and getting data on their living status. Survey form is prepared by Power Engineering and Consulting Company No3 (PECC3). This survey is carried out on 136 of PAPs and the result of socioeconomic survey is used for planning resettlement and evaluating the restoration of PAPs' livelihoods post-project construction. There were 136 PAPs were researched interviewed for the economic status. Of which, the biggest has 11 members, the smallest one has 2 members. The average family size is 5.8 member. The average income of PAP is 1,200,000 VND/month, PAPs earn income mainly from agricultural activities More than 70% of PAPs are supplied with electricity, have well and TV; 60% of PAPs have bicycle, 50% of PAPs have radios, 40% have motorbikes; 10% of them have telephones. Most of houses are type IV (According to Viet Nam standards). There are primary school and healthcare center in each commune. Total number of PAPs would be impacted by the project is 550 households with 2949 persons. Total number of houses would be affected is 100, of these 98 houses would be fully demolished and 02 house would be partly demolished. However, all of PAPs affected on house still have sufficient remaining land for reorganizing their houses. There are not any PAPs have to be resettled to the new sites. .Total area of temporarily affected land is 301,803 m2, and land area to be permanently acquired for substations, pole foundations and access roads is 96,270 m2. Most of the affected land is agricultural land, affected trees mainly are fruits trees and cash crops such as rubber, cashew, pepper, coffee,... Table I 1 and 1.2 of chapter 1 shown locations of substations and transmission lines All the substation and T/Ls would be located in low land (go though rice field) or closed to the roads. There are no EM living in communes passed by T/Ls, therefore, no impacts on ethnic minorities, The affect of project is classified into 7 categories as described in Resettlement Policy, the number of PAPs, and impacts are breakdown by subprojects and by categories shown on tables 3.lato 3.2 below. Therefore the economic restoration program is not required . However, should the designs change in the detail design phase and there are PAPs with more than 25% of their land and incomes permanently affected, the proposal for rehabilitation program will be developed by PC2 based on consultation with local authorities and PAP. This proposal will have to be submitted to World Bank Hanoi for review before commencing with the construction. However, all of PA-Ps affected on house still have sufficient remaining land for reorganizing their houses. There are not any PAPs have to be resettled to the new sites. Therefore, site development for resettlement is not required. RAP OF SUB-PROJECTS MANAGED BY PC 2 30 CHAPTER V INSTITUTIONAL ARRANGEMENTS 1. Electricity of Vietnam (EVN) and Power Company No. 2 (PC2) EVN is the investment owner of the project has authorized Power Company No.2 (PC2) to plan and implement all the aspects of the project, including RAP implementation. For direct work on the ground, PC2 will be helped and -closely coordinated by Provincial People's Committees, and local relevant institutions. 2. Provincial People's Committees (PPCs): The Project PPCs are responsible for approving RAP and clearly direct/demarcate the responsibilities for their relevant institutions in implementing RAPs. Approve the costs of compensation, allowances and establishing appraising committees, compensation committees at all different administrative levels and approve lands for compensation. Redress complaints and grievances 3. Provincial Price - Financing Department, Construction Department and Land Departments The Provincial Price - Financing Departments are responsible for researching and issuing unit prices of compensation and then propose to PPCs for approval. At the beginning of the RAP implementation the Price-Financing Departments will closely co-ordinate with Construction Departments, Land Offices, Agricultural and Development Departments, People's Committee of districts and independent monitoring agency in order to evaluate the applied unit prices in RAP and propose to PPCs for the adjustment, if necessary for ensuring that the compensation unit costs are at the replacement value at the time of compensation payment. 4. Provincial Resettlement Committees Provincial Resettlement Committees are mainly responsible for - assist developer and compensation committees of districts in preparing detailed plans for compensation and resettlement. - Checking all inventory of impacts and detailed implementation plans submitted by Compensation Committees of districts. Approval for implementation plans by District Resettlement Committee. - Solving complaints if the redressal is fail at the district level. Provincial Compensation Committees will consist of the following representatives: - Price - Financing Department RAP OF SUB-PROJECTS MANAGED BY PC 2 31 - Construction Department - Land Office - Chairs of People's Committees of related districts. - Representative of Provincial Project Management Boards 5. District People's Committees Being responsible for guiding compensation and resettlement activities in district areas. People's Committees of districts are responsible for: + Direct the relevant institutions for carrying out impact survey; public consultation, information dissemination on the resettlement policy and RAP implementation. ± Establishment of District Compensation Committees + Responsible for settle complaints of PAPs at district levels. 6. District Resettlement Committees These are key institutions being mainly responsible for implementing RAP in district areas, Resettlement Committees of districts consist of experienced officers of the data-gathering inventory. Resettlement Committees of districts are mainly responsible for: + Organize the survey team to carry out Detailed Measurement Survey (DMS) for affected houses and assets; finalize DMS and Entitlement forms for each PAP. + Checking the unit prices of compensation as used in RAP, suggest for adjusting the unit prices in conformation with market prices/ replacement costs ( if required). + In co-ordination with PMB, organize the meetings with PAPs, communes, disseminate the RIB, DMS and entitlement forms to PAPs. -+- Based on the policy and approved process in RAP, prepare the detailed implementation plan (quarterly, semi-annual, annual plans) and the together with PMB pay entitlements to PAPs in a timely manner. + Settling the complaints and grievances of PAPs, solving any difficulties during the implementation period, and suggest the solutions for the outstanding issues to Provincial Resettlement Committees and Developer. Resettlement Committees of districts will be headed by Vice Chairs of districts. The district ,Resettlement Committee will be consisted of the following departments/offices - Representative of Economic department - Representative of Land office - Representative of Industrial department - Representatives of affected communes - Representatives of PAPs 7. Commune People's Committees People's Committees of communes will be responsible for: * Contribute to census and inventory surveys. * In co-ordination with Resettlement Committees of districts for public meetings, information dissemination, compensation/ allowance payment to PAPs. RAP OF SUB-PROJECTS MANAGED BY PC 2 32 * Transfer all feedback by PAPs to District Compensation Committees and settle the complaints at the communal level. Suggest the solution for the outstanding issues (if any). * Assisting local people in overcoming the difficulties during the construction period, assist PAPs in repairing of affected houses. Arrange land for land in the case PAPs require compensation by land for land. 8. Project Affected Persons (PAPs) PAPs are responsible for carefully checking on their lost assets and respective entitlements and clear land in a timely manner once PAPs receive full entitlements. 9. The steps of RAP implementation are as the followings 1.Establishment of Resettlement Committees This action will be done by PPCs and DPCs just after approval of the project. 2. Public announcement Just after the project approval, PAPs will be fully informed of the project, their rights and the specific policies of this RAP including eligibility provision; entitlement policy; types and rates of compensation, schedules and complaint and grievance rights and mechanism. Such information will be also delivered to the PAPs by PMB under PC2 via meetings and document leaved at Commune People's Committees, resettlement pamphlet will also be disseminated to each PAPs. 3.Detail Measurement Survey PC2 and RCs will carry out DMS and finalize for their entitlements,. The final result of DMS and entitlements will be disseminated to PAP by commune authorities. PC2 and RCs will also clearly inform PAPs on the adjustment for compensation unit costs (if the case). 4. Selection independent monitoring and review unit cost applied in RAP At the early time of RAP implementation, PC2 will prepare TOR for independent monitoring and select the qualified institutions for this task. Independent monitoring agencies will review the RAP implementation and the unit cost applied in RAP, recommend for modifying if it is necessary and inform PAPs on the adjustments for compensation costs. 5. Compensation and allowance payment Compensation for affected residential land, affected houses have to be fully demolished shall be provided at least 5 months prior to the land clearance. Full compensation for other assets and subsidy/allowances be paid at least one month prior to land clearance. 6. Monitoring This task will be done by PC2, its PMB and independent monitoring agencies through out the whole period of RAP implementation. 7. Schedule One of provisions of this RAP is that RAP should be done in accordance with proposed basic principles. All RAP activities must be satisfactorily completed before the World Bank will give a no objection for award of contract for the sub-projects. Any changes to the RAP after WB RAP OF SUB-PROJECTS MANAGED BY PC 2 35 clearance will require review by the WB Office in Hanoi before commencement of construction. This means that construction works must be logically followed and not preceded the execution of RAP program. In otlher words, in case of retards in RAP execution, the delay will be reflected in construction works. The proposed schedule for RAP implementation is as below. F'or PAPs who have be relocated, local authorities and PMB will make evrv effort to a.swist them in purchasing residential land and construction for their house and to be sure that, no land clearance if these PAPs haven 't completed for the houses at new sites. All RAP activities must be satisfactorily completed before the World Bank will give a no objection for award of contract for the sub-projects. Any changes to the RAP after WB clearance will require review by the WB Office in Hanoi before commencement of construction. COMPENSATION COSTS Compensation prices for houses, land and trees/crops are calculated based on the published tariffs of Provincial People's Committees. The unit cost for compensation issued by PPCs based on the Decree 22/1998 CP of GOV and Circular 145 of MOF: 1. I Compensation for land: Article 8 of decree 22/CP states that the prices of land for calculation of compensation for recovered land shall be determined on the basis of local prices of land issued according to the provisions of the Government multiplied by a coefficient 'K' in order to ensure compatibility of the compensation with profitability and the price of transfer land use right in the locality. 1.2 Compensation for house: Article 17 of Decree 22/CP states that house will be compensated from 60% to 100% of the new house value, for this RAP , compensation for house calculated at 100% value of new house. 1.3 Compensation for annual crops: Article 23 of Decree 22/CP guides that, compensation for annual crops are calculated based on the average yields of the latest three years multiply with market price at the calculation time. 1.4 Compensation for trees and fruit trees: Article 23 of Decree 22/CP guides that, trees will be compensated at the actual values at the time of land acquisition ( Fruit trees are be compensated for the remaining harvests) 1.4 Compensation for other assets such as electric meter, telephone reinstall, tomb, well etc are at replacement costs. Check the unit cost issued by PPCs with local contractors, and with PAPs (through consultation), consultants see that, the published tariffs of PPCs are the same as the replacement costs and market prices at the time of the RAP preparation. To follow the project resettlement policy, at the time of RAP implementation, the relevant departments under PPC and an Independent monitoring Agency will carry out the survey on replacement cost for land, house, trees and market price for crops, the adjustment for compensation unit costs would be made by PPC (if required) for ensuring that compensation for land, house, trees are at replacement cost and crops are at market prices. Cost estimate for RAP is as below: Total compensation cost is estimated as 8,111,3 16,124 VND. RAP OF SUB-PROJECTS MANAGED BY PC 2 57 CHAPTER VIII PARTICIPATION AND CONSULTATION 1. OBJECTIVE Consultation with and participation of local authorities and PAPs in the preparation and implementation phases of RAP to get their feedback can reduce contradiction and restrain the possibility of project delay, help PMB in meeting the needs of PAPs so that it can increase the project's social-economic benefit. The purposes of consultation and participation for RAP are: + Sharing fully information of project's and its potential impact + Encouraging the participation of communities in the RAP design and implementation. + Gathering information of the needs as well as reactions of PAPs again policies and proposed works in order to correction in implementation. 2. STAGES OF CONSULTATION AND PARTICIPATION During the preliminary survey (5-6/2001), the survey teams of consulting companies have informed and got feedback from local authorities and PAPs on: i) locations of proposed substations and alignments for the T/Ls; ii) the project affected areas; iii) eligibility to compensation and rehabilitation; iv) entitlement policy; and v) mechanism for complaints. Local authorities and PAPs support for the project construction and agreed with the proposed resettlement policy. PAPs opted cash compensation for their loss assets and prefer to organize the new houses construction by themselves. PAPs have also suggested that PMB should officially inform them about the project implementation schedule, steps of compensation payment and land clearance as well as supervise for transparency in RAP implementation. The question on options of PAPs for compensation mode also included in the inventory form which prepared by consulting companies and fulfilled by PAPs (in June- December, 2001). After draft RAP has been prepared, the draft RAP has been sent to PCCs of 11 provinces in early January, 2001 for review, comments and disclosed at PCC and DPC offices. EVN and PC2 have requested PPCs of 11 provinces and their relevant institutions to carefully review for the requirements on wavers, eligibility to compensation, proposed entitlement policy, RAP cost, taskforces, mechanism for complaint and applied unit costs in draft RAP. PPCs of 11 provinces and their relevant institutions are reviewing and their comments will be sent to EVN within March, 2002. Meetings were held with all the relevant institutions of 11 provinces such as Women Union, Farmer Association, District officials, Communes and PAPs. In these meetings, consultants have fully informed participants on the proposed project and its proposed resettlement policy, potential impacts on natural and social environment and mitigation measures. PAPs agreed with the draft policy on resettlement and mitigation measures for the RAP OF SUB-PROJECTS MANAGED BY PC 2 58 adverse impacts on environments. Some sample of questionnaire form and minutes of meetings were attached with RAP as an annex. The draft RAP has also been disclosed at the offices of PPCs, at VDIC of the World Bank office in Viet Nam. Stagte 3 After RAP cleared by the World Bank and GOV, meetings will be organized by PC2 and RCs of 1 I provinces. In these meetings, PAPs will be officially introduced about the project, the policies approved in RAP and details on entitlement policy and implementation schedule. The procedure of complaint and grievances will be clearly guided. Booklets about project and RAP will also be prepared by PC2 and distributed to PAPs. The final DMS and entitlement calculation for each PAP will be also disseminated to PAP and commune authorities for checking and compensation procedure (times, values) will be clearly announced by PC2 and RCs of 11 provinces. RAP OF SUB-PROJECTS MANAGED BY PC 2 59 CHAPTER IX GRIEVANCE REDRESS PAPs complaints and grievances will be dealt with according to customary procedures and according to Vietnamese law. PAPs complaints shall be treated fairly and must be facilitated with assistance as they plead their cases. In addition no fee should be levied on them and in case legal supports is necessary this shall be given to them free of charge. 1. COMPLAINTS AND GRIEVANCE PROCEDURE The complaints and grievances settling procedure entail 4 appeal levels as below: a) Firstly, complaints and grievances will be sent to PC of commune. PC of commune will forward that to the PMB under PC2 and they shall try in any possible way to settle complaints and grievances by means of direct negotiation between representatives of PC of commune, the PMB and the PAPs within 15 days from the day received complaints and grievances. b) Secondly, if the first attempt is fail, the complaints will be brought to the district authorities. The district PC is responsible for resolving the complaint and official answer to PAP within 15 days from the date it received complaint. c) Thirdly, if the second attempt also fails, the complaints will be brought to Province's Authorities. The period for resolving is 15 days. d) Finally, if the agreement has not been reached yet, the disputes shall be brought for settlement to the Court of District following the law of complaints and grievances. 2. LEGAL GUARANTEE FOR COMPLAINT AND GRIEVANCES In order to assure that the PMB consider PAPs complaints and a fair settlement of litigation cases, negotiations will always be monitored by witnesses chosen by the PAPs. Moreover, the PAPs will have the right to request the timely assistance of their elected representative. RAP OF SUB-PROJECTS MANAGED BY PC 2 60 CHAPTER X MONITORING AND EVALUATION The implementation of RAP shall be constantly supervised and monitored internally by PC2 and its PMB in co-ordination with local Peoples' Committees. There will be an independent monitoring of the RAP implementation. The interested institutions have to submit their technical and financial proposals to PC2 for review and then to WB for its concurrence. The independent monitoring institution(s) shall be contracted by the PC2 immediately after RAP approval and shall begin supervision and monitoring activities from the beginning of the implementation phase. Terms of Reference for independent monitoring will be prepare by PC2 and then submitted to the World Bank for its concurrence. 1. INTERNAL MONITORING DUTIES Internal supervision and monitoring include the following activities: a) Monitoring the population and socio-economic surveys of PAP and the inventory of PAP assets, status, occupations and living conditions and supervising the implementation of compensation, resettlement and rehabilitation for the PAP in the terms agreed by the PAPs. b). Monitoring whether the implementation of resettlement and compensation tasks are carried out as provided in this RAP. c) Monitoring the availability and quality of replacement land d) Monitoring the timely and sufficient deployment of resettlement and compensation funds or of replacement land as prescribed by this RAP. e) Investigate and fairly assess each case of complaint and grievance. f) Internal monitoring agencies will prepare a quarterly report detailing the progress of RAP implementation. Such a report should be made available to appropriate GOV authorities, WB, and external monitoring agency/consultants 2. INDEPENDENT MONITORING Beside evaluation the quarterly reports produced by internal monitors and conduct the same king of investigation assigned to internal monitoring, the external monitoring agency will be responsible for the following: a) Evaluation of inventory survey and entitlements determination. Check for the unit costs applied in RAP to see if they are still at replacement costs/ market prices at the time of RAP implementation. Recommendation for modification to PC2 if necessary. b) Evaluation of socio-economic project impacts on the PAP. RAP OF SUB-PROJECTS MANAGED BY PC 2 61 c) Supervision of the implementation of RAP to achieve the objectives of the RAP in particular" to improve or at least maintain the incomes and living conditions of the PAP after the resettlement." d) Putting forward the amendments for the implementation of RAP to achieve the objectives of this RAP. e) Offering suggestions on how improve RAP programs f) Closely monitoring compensation activities and be prepared to give informed evaluation of complaint and grievances cases. g) Write working reports and submitted to PC2 and its PMB and WB.
