Resettlemenit Action Plan: is a time-bound action plan with resettlement strategy, objectives, impacts, entitlement, socio-economic survey, policy framework, legal framework, measures to minimize impacts, resettlement sites, compensation, income restoration, resettlement implementation arrangement, resettlement schedule, participation and consultation, grievance redresses, monitoring and evaluation, monitoring and evaluation, and possibly indigenous people I development plan. Proiect Affected Persons (PAPs) or Displaced Persons (DPs) indicates any juridical persons I who may be an individual, a household, or a private/pubic firm on account of the execution of a project, or any of its components or sub-projects or parts thereof would have their: (i) right, title or interest in any house, land or any other asset acquired fully or partly I (ii) business, occupation, work, place of residence or habitat adversely affected; or (iii) Standard of living adversely affected. | Coin pensationi means payment in cash or a kind to replace losses of land, housing, income, and other assets caused by a project. I Entitlemnent defines a right to receive mitigation measures such as compensation, income restoration, relocation assistance, and other supports. I Inconie restoration/Livelihlood restoration/Rehabilitation means the process to restore income earning capacity, production levels and living standards in a longer term. Replacement cost is the method of valuation of assets that helps determine the amount sufficient to replace lost assets and cover transaction costs. (i) For agricultural land, replacement cost of an affected plot is the value to buy a plot which has an equal profitable potential and is located in a vicinity of the affected plot plus the cost of preparing the plot to a level similar to those of the affected plot, plus the cost of any registration and transfer taxes. (ii) For land in urban areas, it is a pre-displacement market value of a plot of equal size and use, with similar or improved public infrastructure facilities and services and located in the vicinity of the affected land, plus the cost of any registration and transfer taxes. (iii) For houses and other structures, it is market costs of materials to build a replacement structure with an area and quality similar to or better than those of the affected structure. Or it is the cost to repair a partially affected structure, plus the cost to transport building materials to the construction site, plus the cost of any labor and contractors' fees, plus the cost of any registration and transfer taxes. In process to determine replacement cost, depreciation of asset and value of salvable materials are neither taken into account nor the value of benefits derived from the project. I PowerEngineering& Consulting Company 2 3 I~IT RAP of 220 KVSoc Trang Substation Census is a data collection technique of completing enumeration to all PAHs and their assets through household questionnaire. Objectives of the census are (i) to prepare a complete inventory of PAHs and their assets as a basis for compensation, (ii) to identify non-entitled persons, and (iii) to minimize impact of later influx of "outsiders" to project area. Socio-economic survey is carried out in order to collect profile data of PAHs and to prepare for Resettlement Plan. A sample about 25% of PAHs is surveyed through a household questionnaire. The survey result is used (i) to assess incomes, identify productive activities, and plan for income restoration, (ii) to develop relocation options, and (iii) to develop social preparation phase for vulnerable groups. Cut-off date determines eligibility for entitlement. The cut-off date could also be the date the project area was delineated, prior to the census, provided that there has been an effective public dissemination of information on the area delineated, and systematic and continuous dissemination subsequent to the delineation to prevent further population influx. Vulnierable group is defined as indigenous people, ethnic minorities, the poorest, women, children, the aged, the disabled, and other socially/economically vulnerable groups who could be adversely affected from a project. Grievanice Redress procedures are set out the time frame and mechanisms for resolutions of complaints about resettlement from PAHs. Grievance redress can be carried out through informrally-constituted local committees with representation from key stakeholder groups. Grievances can also be addressed through formal channels. With an unresolved grievance, it will be dealt with at progressively higher levels. 1~71 I I I~ ~ ~)Pw niern& o ligC)/cn I. RAP of 220 KVSoc Trang Substation EXECUTIVE SUMMARY 1. The Project and Resettlement Action Plan The substation 220 kV in Soc Trang Province is a subproject of the System Efficiency Improvement, Equitization and Renewable (SEIER) project that would be constructed to meet the demand of power consumption of Soc Trang Province in the period of 2006-2020. This I subproject includes (i) Soc Trang 220 kv substation; (ii) Access road to the station; and (iii) Management office. To carry out the subproject, it would acquire land from six families only and therefore only an Abbreviated Resettlement Plan is prepared. According to the World Bank's OD 4.20, an Abbreviated Resettlement Plan mainly covers the following minimum elements: (1) a census survey of displaced persons, and valuation of assets; (2) description of compensation and other resettlement assistance to be provided: (3) consultation with displaced I persons about acceptable alternatives; (4) institutional responsibility for implementation and procedures for grievances redress;: and (5) a timetable and budget. 2. Objectives of Resettlement Action Plan The main objectives of resettlement plan are (i) to minimize adverse impacts on land acquisition; and (ii) in unavoidable case, a resettlement plan will be prepared in order to make sure that DPs can improve or otherwise will be at least restored their livelihood as pre-project implementation 3. Legalframework Abbreviated Resettlement Action Plan (ARAP) for this project is based on laws and relevant Decrees of Viet Nam related to compensation and resettlement and OD 4.20 on involuntary resettlement of the World Bank. Eligibility for compensation and/or rehabilitation entitlement and other assistance includes all individuals, households and institutions who will be affected by the project, either temporarily or permanently. 4. Project impacts The project will impact on: - Permanent land acquisition for the substation, access road; connection tower and * under cable line. - Permanent houses, structures, trees, crops and other assets. * - Temporarily acquired land required during construction of the project. Entitlementtpolicy All of the project affected individuals, families, institutions in the project area will be compensated for their lost assets and will be assisted with allowances and subsidies in a transition I period to make sure that they could at least restore their livelihood. Compensation costs and allowances will be based on decision of STPPC and at the replacement values. | 6. Participation and consultation Consultants of PECC2 have carried out consultation with the DPs. The consultation include asking DPs with some formal questions in the questionnaire (such as options for compensation in cash or in kinds, option to be resettled to resettlement site or self-relocation with cash compensation etc.,). Survey team has also asked DPs about the proposed economic restoration | programs and any special needs required for resettlement in order to shorten the transition period. 7. Complainit anid monlitorinig During the project implementation, the DP's complaints will be dealt with according to the regulations of Vietnamese laws. The complainant will be treated fairly and to be guided by related agencies on the order, procedures. In addition, no fee will be charged for their complaints. PowerEngineering& Constulting Company 2 6 Is RAP of 220 KVSoc Trang Substation The implementation of RAP shall be constantly supervised and monitored by the Project Management Unit under the Southern Power Project Management Board and all relevant local authorities to make sure that RAP will be implemented smoothly. 8. Inistitutional arrangemenits Project Management Unit (PMU) will be mainly responsible for all of operations on investment guidelines, investigation and design, project construction as well as supervision of compensation and resettlement of the project. The Project Management Unit is also responsible for directly guiding the whole implementing process of the project including RAP implementation to all related institutions. To successfully implement RAP, PMU will be assisted by Soc Trang Province, district and ward authorities. 9. Scheduile RAP will be implemented in a close linkage to civil works. Detail schedule of RAP implementation will be planned later at the detail design phase of the project. The project affected persons will be clearly informed about the quantity of their loss assets, entitlement policy, compensation unit cost, compensation amounts and RAP implementation schedule. 10. Cost estimate Total compensation cost is estimated at about VND 3,910,759,692 equivalent to USD 248,302 This cost includes costs for compensation, rehabilitation activities allowances, as well as administrative management. 1. INTRODUCTION 1.1 The subproject Soc Trang Province is the big one of Viet Nam. Its power consumption is at a high rate and increasing rapidly from time to time. According to a forecast by the Energy Institute, the total capacity of substations needs to be increased about 70% up to 2020 to meet with demand of industry, domestic use. Its current power network needs to be upgraded and expended through many programs such as national program, city program and programs of some international donors such as the World Bank and Asian Development Bank. A substation 220 kV in Soc Trang is a subproject of the System Eficiency Improvement, Equitization and Renewable (SEIER) project that would be constructed to meet the demand of power consumption of Soc Trang Province in the period of 2006-2020. This subproject includes (i) Soc Trang 220 kv substation; (ii) Short access road to the substation; and (iii) Management office. 1.2 Objectives of Resettlement Principles and objectives of this RAP are defined in accordance with Vietnamese laws and the OD 4.20 of the World Bank on involuntary resettlement. PowerEngineering& Consulting Conmpany 2 7 lUl RAP of 220 KVSoc Trang Substation o Involuntary resettlement and loss of means of livelihood are to be avoided where feasible through exploring all viable alternatives. But when, after examined, if it is proved unavoidable, then effective measures to minimize impact and to compensate for losses must be agreed with the people who will be affected; o People to be resettled involuntarily and people whose means of livelihood will be hindered or lost must be sufficiently compensated and supported by the project proponents, etc. in a timely manner; o The project proponents must make efforts to enable the people affected by the project to improve their standard of living, income earning opportunities and production levels, or at least to restore them to pre-project levels. Measures to achieve this include: providing land and monetary compensation for losses (to cover land and property losses), supporting means for an alternative sustainable livelihood, and providing the expenses necessary for 3 relocation and the re-establishment of a community at relocation site; and; o Appropriate participation by the people affected and their communities must be promoted | in planning, implementation and monitoring of involuntary resettlement plans and measures against the loss of their means of livelihood. | To achieve these objectives, Resettlement Plan should be designed so as to follow the improvement or at least a maintenance of the DP's pre-project living standards. 2. LEGAL FRAMEWORK This Abbreviated Resettlement Plan is prepared in accordance with the project resettlement policy. This policy is developed based on the relevant laws of Viet Nam and OD 4.20 of the World Bank on involuntary resettlement. Key laws, decrees of Government and Circulars of line Ministries, policies of STPPC on compensation, support and relocation are as follows: I - Land law issued on November 26, 2003. - Decree 181/2004/ND-CP on October 29, 2004 guiding the implementation of the land law 2003. I - Decision No. 153/2004/QD-TTg of Prime Minister on August 17, 2004 promulgating the strategy orientation for sustainable development in Viet Nam (Vietnam's agenda 21). - Decree 197/2004/ND-CP on December 03, 2004 on compensation, support and resettlement * when land is recovered by the State. - Circular 116/2004/TT-BTC on December 7, 2004 guiding the implementation of compensation, support and resettlement when land is recovered by the state. I - Decree 188/2004/ND-CP on November 16, 2004 on methods to determine land prices and assorted land price brackets. - Circular 114/2004/TT-BTC on November 26, 2004 guiding the implementation of the Government's Decree No. 188/2004/ND-CP on methods to determine land prices and assorted land price brackets. - Decree 198/2004/ND-CP on December 3, 2004 on collection of land use levies. - Compensation and resettlement policies of Soc Trang province: (i) Compensation unit costs for lands (Decisions no. 11/2005/QD.UBNDT dated February 14 ', 2005); (ii) Compensation units cost for house, other structures and trees (Decision no. 285/QD.HC.05 dated March 23th, 2005); PowerEngineering& Consulting Company 2 8 Il RAP of 220 KVSoc Trang Substation 1 3. EFFORTS IN MINIMIZING LAND ACQUISITION The site of Soc Trang substation was selected based on the considerations of technical, environmental and social viewpoints. These issues were carefully studied by checking at the site and through consultation with local people, Soc Trang town authorities. There are several alternatives studied. The site was selected with a shortest distance to connect to the existing grid so that it would minimize impact to people under the right of way and in a thin population area. Thanks to this consideration, only 06 HHs will be affected by all different categories (on land, building, crops and trees etc.). 3 4. SIOECONOMIC CONDITION, CENSUS AND INVENTORY 4.1 The socio-economic condition of DPs | The socio-economic survey was carried out for all of DP (06 households). Average of family size is 04 persons . Of which, woman is 49 %, man is 51%. Most of the DPs are doing farming. The average income of affected families is about VND 33 million per year. Most of the DPs have U electricity, drilling well, television, telephone, motorbike, refrigerator and furniture. Impact on cleared residential areas will be temporary as it can be reused for restricted purposes. 5 DP who has houses, which are partially or totally damaged, and the damaged portion will affects to the safety or using purpose of the 3 entire house or structure, so the house/structure need to be totally removed and rebuild. But DP does not have sufficient spare residential 1 land for the reconstruction of a house of equal dimensions as the house lost. The threshold of sufficient residential land is at 100 m2 for rural areas. PRINCIPLES, ELEGIBILITY TO COMPENSATION AND ENTITLEMENT 5.1 Principle Resettlement Plan should be designed to achieve an improvement or at least a maintenance of the DP's pre-project living standards. (a) Both Resettlement and land acquisition must be minimized as much as possible (b) Resettlement distance must be minimized. If the agricultural replacement land needs to be given, then it should be as close as possible to the land acquired. (c) Cash compensation for land, houses or structures shall be given at the replacement | costs free from depreciation cost of the salvage of the old construction materials. Trees shall be compensated at replacement cost (the cost of a seedling plus annual income from the tree multiplied by the number of years that it takes for the seedling to be harvestable). Cash compensation for crops shall be given at market price rates. (d) Resettlement transition period must be minimized and compensation should be paid to DPs at least one month before the start of construction activities. No land clearance if a full compensation has not been done. (e) Resettlement and land acquisition plans and all replacement alternatives should be I carried out following consultation with the affected population and it should have popular acceptance of DPs. The plans are also required to be approved by local Authorities. (f) Resettlement and compensation programs must provide adequately institutional arrangements to warrant effective and timely implementation and proper monitoring. I (g) Financial and technical resources for the resettlement, land compensation and subsidies should be available when and where required. (h) The previous level of community services and resource should be maintained or I improved in the new sites. (i) Once approved by Soc Trang Province People's Committee, what stipulated in this RAP will be enforceable as an official legal document. lJ PowerEngineering& Conslulting Company>2 14 I II II RAP of 220 KVSoc Trang Substation * 5.2 Displaced Persons and eligibility The DPs include the following persons to be identified by the baseline information collected for the Resettlement Plan: (a) persons whose houses are partly or fully affected (temporarily or permanently) by the I project; (b) persons whose residential and/or agricultural land is partly or fully affected (permanently or temporarily) by the project; (c) persons whose businesses are partly or fully affected (temporarily or permanently) by the project; and I (d) Persons whose crops (annual and perennial) and trees are partly or fully affected by the Project. The displaced or project-affected people eligible for compensation will include: (a)those who have formal legal rights to land or other assets; (b) those who currently do not have formal legal rights to land or other assets but have a claim to legal rights based upon the laws of the country; upon possession of documents such as land tax receipts and residence certificates; or upon the permission of local authorities to occupy or use the project affected plots; and (c) those who have no recognizable legal right or claim to land they are occupying. Persons covered under (a) and (b) are provided compensation for land they lose, and other assistances. Persons covered under (c) are provided resettlement assistance, in lieu of compensation for land they occupy, and other assistance, as necessary, to achieve the objectives set out in this policy, if they occupy the project area prior to the cut-off dates defined in RAP. 5*Persons who encroach on the project area after the cut-off date defined in the RAP are not entitled to compensation or any other forms of resettlement assistance. The cut- off date of this RAP is June 02, 2004. 5.3 Impact Categories By the nature of the project impacts based on the survey of the DPs, the impact categories could be classified as below: Temnporary Impact All persons have land, crops, trees or structures to be temporarily affected only during the construction period. Permaneint Impact All persons own lands and properties on it, which will be permanently acquired for the project implementation. These allowances/ subsidies are as below: (a) Subsidy for moving to new site (transport allowance) 3 This allowance is for DPs who have to be relocated to new sites: i) PAPs who have to relocate within the City will be entitled to an allowance from VND 1,000,000 to VND 3,000,000; ii) DPs who have to relocate out of City will be entitled to transport allowance of 5 VND 3,000,000 to VND 5,000,000. This subsidy allowance is for the transportation of their salvageable materials and living facilities from affected site to the relocating sites. (b) Relocation Subsidy for Resettlement This subsidy allowance is a food allowance for DPs who will be relocated or reorganized in * remaining land, and therefore they have to reconstruct their new houses. Each member DPs will be equivalently subsidized 30kg rice per month in six months. (c) Rehabilitation Allowance * Vulnerable groups (the elderly, woman-headed householder, disable etc.,) and DPs who are permanently affected more than 20 % of total productive land area and or lost permnanently 3 more than 25% of their incomes will be entitled to training with 5,000,000 VND/ person. (d) Bonus for self-relocation * DPs opting for self-relocation will be received a bonus package of VND 10,000,000 per HH I 6. RELOCATION AND ECONOMIC RESTORATION PROGRAMS As described in (4) above, there are only one HH have to move to new site, and therefore, relocation I site development for the DP is not necessary. Through consultation with the DP, DP agreed to receive compensation in cash to manage relocation themselves. In the implementation period, the I DP will be assisted by PMUT and local authorities in purchasing and constructing their houses. There are six HHs losing more than 25% of their total productive land. These families will be entitled to an economic restoration assistance . It is VND 5,000,000 per HH. And these families will be assisted with vocational training or any activity of economic restoration which they prefer. 7. CONSULTATION AND PARTICIPATION Information dissemination to, consultation with and participation of the affected people and involved agencies are to (i) reduce the potential of conflicts, (ii) minimize the risk of project delays, and (iii) I + Po(uerEngineering& Consulting Conmpan 2 18 l ~~~~~~I l RAP of 220 KVSoc Trang Substation enable to design the resettlement and rehabilitation program as a comprehensive development program to fit needs and priorities of the affected people, thereby maximizing economic and social I benefits of the project investment. The objectives of the Public Information Campaign and PAP Consultation Program are as follows: 3 - To fully share information about the proposed project, its components and its activities associated with the affected people. - To obtain information about needs and priorities of the affected people as well as I information about their reactions/feedback to proposed policies and activities. - To obtain cooperation and participation of the affected people and communities when implementing the resettlement plan. - To ensure transparency in all activities related to land acquisition, resettlement and rehabilitation. I Soc Trang town authorities and the DPs were consulted through surveys and for the RAP on issues such as (i) alternatives of substation site, route of access road and cable; (ii) DP's choice to modes of I compensation (in cash or in kind); (iii) compensation units cost recently issued by STPPC; and (iii) implementation arrangement (payment flow, complaint mechanism, monitoring etc.) Feedback of Soc Trang town authorities and the DPs on the proposed project sites and relocation preference were taken into account by engineers and resettlement planners. 3 The consultations were carried out through questionnaire of survey, meetings and individual interview. The consultation and participation will be continued through the whole period of the RAP implementation. 8. INSTITUTIONAL ARRANGEMENT Soc Trang Province People's Committee, PMU and other administrative levels will be responsible for implementing the RAP. The co-ordination between the project developer and local authorities I should be made closely in order to implement the RAP smoothly and effectively and to minimize a delay of the project. | 8.1 Institutional Arrangements The following institutions/agencies will be involved in implementing RAP: - People's Committee of Soc Trang Province and Soc Trang Town authorities * - Southern Power Projects Management Board (PMU) - Departments of Finance, construction and Natural Resources and Environment - Town Compensation council - Ward People's Committees 1 + PowverEngineering& Consulting Conmpany 2 19 I | l 3 RAP of 220 KVSoc Trang Substation 8.2 The functions, tasks and responsibility 3 Soc Trang Province People's Committee STPPC is responsible in directing compensation and resettlement to Soc Trang Town compensation, 3 support and resettlement council. It will be also responsible for approval of compensation plan and involves to complaint redresses. 3 Project Management Unit: Southern Power Projects Management Board are responsible for implementing the RAP, including I impact survey, payment of entitlements, implementation of restoration program, resolution of complaints, internal monitoring. I City Department of Finance, Department of Construction and DONRE: The city Department of Finance is responsible for researching and issuing unit prices of compensation and then proposing to City PC for approval. At the beginning of the RAP implementation the Department of Finance will closely co-ordinate with the Department of E Construction, DONRE, and People's Committee of the district in order to evaluate the applied unit prices in the RAP and propose to City PC for adjustment if necessary. It is to ensure that the compensation unit costs are at replacement values at the time of compensation payment to the DPs. I Town Compensation council The District Compensation, support and resettlement council is mainly responsible to: - Assist PMU in preparing detailed plans for compensation and resettlement. - Conduct inventory of impacts, prepare detailed implementation plan for compensation and resettlement, pay compensation to PAP and help them in moving out of the project affected areas. - Solve complaints at the district level. Ward People's council | Ward People's Committees will be responsible for - Contributing to census and inventory surveys. - Co-coordinating with Compensation, Support and Resettlement council of districts on 3 issues related to RAP implementation such as public meetings, information dissemination, compensation/ allowance payment to DPs. - Transferring all feedback by DPs to District authorities and settle the complaints at the 3 ward level. Suggest the solution for the outstanding issues (if any). - Assisting DPs in overcoming the difficulties during the construction period. | Displaced Persons (Project Affected Persons) The DPs are responsible for carefully checking on their lost assets in the DMS form and respective entitlements in the Entitlement form before signing in these forms. 1 +i3 PowerEngineering& Consulting Company 2 20 I l 3 RAP of 220 KVSoc Trang Substation l 9. TASK FORCES AND IMPLEMENTATION SCHEDULE 9.1 Task forces 1. Announcemeltt to DPs All DPs shall be fully informed about rights and policies of the RAP including eligibility, 3 entitlement policy, modes and rates of compensation, schedules and complaint and grievances rights. In addition, a Resettlement Information Booklet (RIB) will be prepared by PMU and then delivered to all DPs or informed at meetings in districts and wards; hung in public places such as ward people's committee and school etc. The public announcement tasks shall be implemented immediately after Soc Trang Province approval of project is obtained. 2. Compensation deadlines 3 Compensation for affected assets will be paid before land clearance. For DPs who have to be relocated, local authorities and PMU will make every effort to assist them in purchasing land and reconstructing their houses and to be sure that, no land clearance if these DPs haven't completed the reconstruction of their houses at new sites yet. 3. Resettlement and clearance deadline The impacted DPs on houses and land after receiving full compensation and subsidies are requested to move out of the affected portion of the houses for clearing land at least 15 days before the work commenced. 4. RAP implementation process RAP implementation will include three major actions as below: a) General action: Just at once when beginning the project implementation work. b) Separate action: at several times, once for each component of the project. c) Continuous action: Continuous action for stages of RAP implementation. 9.2 Basic actions of the project 1. Action 1: Establish Compensation, Support and Resettlement Committee. 3 Just after the investment approval of the project, Soc Trang towns will establish Compensation, Support and Resettlement Committee. Action 2: Detail Measurement Survey | District Compensation, support and resettlement council carries out the detail deasurement survey of affected assets and together with other related agencies, carry out an evaluation for the applied unit prices in the RAP and propose to Province PCs for readjusting these prices I (if it is necessary). It is to ensure that the DPs are compensated at replacement costs at the time of RAP implementation. | 3. Action 3: Prepare compensation plan Immediately the ends of final inventory survey, Council of Soc Trang Compensation, Support and Resettlement council will inspect and define the official number of DPs, impacted properties and total compensation amount for each HH. | 4. Action 4: Informnatioiz campaign Council of Soc Trang Compensation, Support and Resettlement Committees officially announces the policy, schedule of the RAP implementation to the DPs at public meetings including issues related to compensation, resettlement and land clearance. 1 5. Action 5: Compensation payment to DPs Compensation and assistance are paid for DPs affected on houses, and then for DPs affected on other properties. The DPs are permanently lost more than 25% of total productive land area or incomes will be entitled to rehabilitation assistance. 6. Action 6: Monitoring | During the project implementation, PMU will monitor all actions of RAP implementation and rehabilitation programs. Because of small scale of land acquisition impact, independent monitoring might not be necessary or only individual might be hired by the PMU for this | task. 3 Monitoring includes the following issues: a) Monitoring whether the implementation of resettlement and compensation tasks are carried out as stated in this RAP. | b) Monitoring the availability of budget for compensation and compensation unit costs to make sure that DPs are paid at the replacement costs. | c) Monitoring if compensation to DP is in a timely manner. d) Investigate and fairly assess each case of complaint and grievance. 3 e) PMU will prepare a quarterly detailing report on progress of RAP implementation. The RAP implementation schedule will be with the main following steps: (1) Preparation work, definition of scope and amount of project investment (2) Survey work for the RAP : June-July, 2005 (3) Information campaign: August, 2005 I (4) RAP reviewed by relevant authorities and approved by EVN, cleared by the World Bank: October, 2005 (5) Establishing Compensation, Support and Resettlement council of Soc Trang town: I November, 2005 (6) Compensation Payment, land clearance for the project construction: About 05 months before the beginning of civil work (according to bidding plan) I (7) Implementation of economic rehabilitation programs: In the same time of compensation delivery. (8) Monitoring of RAP implementation and evaluation: Through whole period of I implementing RAP. (9) Commencing with Civil works of the project: After full compensation and completion of house construction of DP at new sites. All RAP activities niust be satisfactorily coinpleted before PMU zive a no obiection for 3 award of conitract for the sub-proiects. 10. COMPLAINT MECHANISM To ensure that the DPs have opportunities to express their grievances related to any aspect of compensation and resettlement, detailed procedures of grievances have been established for the project. Its objective is to respond to grievances of the DPs speedily and transparently. Actions of the mechanism must be convenient, transparent and fair. By resolving grievances at the project level, implementation of the project would be more effective ascertained. The procedures of grievances are as follows: I Stage 1: At ward level 1 If any person is aggrieved by any aspect of RAP implementation, he/she can lodge an oral or written grievance to ward authorities. Ward People's Committee will resolve the issue within 15 days 1 + PowerEngineering& Consulting Compainy 2 23 l I I RAP of 220 KVSoc Trang Substation Stage 2: At district level If a complainant is not satisfied with decision in stage 1, he or she can bring the complaint to district PC. Within 15 days from the date of the receipt of his/her petition, district will reach a | decision on the complaint. Stage 3: At city or district court level If the DP is still dissatisfied with the decision, he/she can appeal to the District People's Court I (DPC) in accordance with the "Civil Procedure Act" or to STPPC within 15 days of receiving the decision of the district without being charged. No fees will be charged to complainant. 11. COST ESTIMATE Compensation cost estimate for house, structure, residential land, agricultural land, trees and crops etc., are based on Compensation and resettlement policies of STPRO.: - Compensation unit costs for lands (Decisions no. 11/2005/QD.UBNDT dated February I 14, 2005); - Compensation units cost for house, other structures and trees (Decision no. 285/QD.HC.05 dated March 23th, 2005); * Cost for the RAP consists of: 3 - Compensation for permanent land acquisition - Compensation for trees and crops - Compensation for houses and structures - Subsidy, allowance for rehabilitation consist of relocation subsidy, transport allowance, training subsidy etc. - Management cost, and I - Contingency cost.
